Abstract: One of the most significant changes of the Spanish insolvency legislation is the creation of a single insolvency proceeding, applicable to all sort of debtors, commercial debtors and non–commercial debtors. Unlike other insolvency legislations, the Spanish insolvency legislation does not provide a consumer insolvency proceeding or specific provisions that respond to the needs of insolvent consumer and private households. The subject of this paper is to describe the most relevant aspects of consumer insolvency and to give a overview of the treatment of consumer insolvency and overindebtedness in German and French Law. Finally this paper also proposes key rules for the regulation of the consumer insolvency in the Spanish Insolvency Act.
